Federal court ruling likely ends foundation fight

OMAHA, Neb. (AP) _ A new federal appeals court ruling will likely end a 6-year-old fight for control of one of Nebraska's oldest and most prestigious charitable foundations. Current and former trustees have been fighting in state and federal court over control of the Gilbert M. and Martha H. Hitchcock Foundation, which has $17.2 million in assets. It was established in 1943 by Martha Hitchcock. Her husband, Gilbert Hitchcock, was a U.S. senator and founder of the Omaha World-Herald newspaper. Two factions of Omaha's Kountze family, which married into the Hitchcock family generations ago, have been fighting over control of the foundation since at least 2002. The two factions disagreed about who would do the best job managing the foundation's assets.
