Discovery motions were argued Friday afternoon in Dawson county district court in Lexington on behalf of 26 year old Jake Johannsen who faces charges of second-degree murder and use of a deadly weapon. Johannsen is charged in the death of 49 year old Rodney Marshall. Attorney Derek Mitchell says his defense motions order the state to produce evidence against his client. Mitchell was granted access to information the state is able to obtain of the criminal history or lack of one of the deceased and a material witness currently incarcerated in Montana, the state wants to depose. The witness is a Canadian national. Mitchell says depositions of witnesses are upcoming from mid to late July. A jury trial is scheduled for September 22nd.
