Motion for rehearing denied

The Nebraska Supreme Court has denied a motion for rehearing of its recent ruling which denied authority to form a village a Johnson Lake, southwest of Lexington. The motion for rehearing was filed by Terry & Josh Barber, lawyers for Glen and Teresa Lanman. The state's high court affirmed the Oct. 2007 ruling of District Judge Donald Rowlands, which confirmed the Dawson County Board's denial of a petition to form a village in nine neighborhoods on the northeast corner of the lake in Dawson county. On April 3rd, the court determined that Johnson Lake is incorporated as a sanitary improvement district and Nebraska law says a village cannot incorporate where a governmental corporation already exists. The Johnson Lake S.I.D. was incorporated in February 2003 to address the need for a taxing base to install a sanitary sewer system at the lake. The S.I.D. is represented by attorneys, Robert Huck and Dave Skalka of Croker, Huck Law Firm in Omaha.
